Why you should train:
While the media focus has been on the legal costs of offensive behavior, the greatest impact of offensive behavior to a company's bottom line comes through absenteeism and turnover. In addition Employer liability for sexual harassment has increased dramatically in recent years. In 1998, for example, the U.S. Supreme Court ruled that not only is same-gender sexual harassment illegal, but also that an employer can be found liable, even if the victim does not suffer any adverse job consequences as a result of the harassment. The Supreme Court rulings did, however, outline potential mitigating considerations, including whether the employer exercised reasonable care in advance to prevent and correct any harassing behavior; and whether the victim unreasonably failed to take advantage of any corrective or preventive mechanisms established by the employer.
Who Should Train:
Both employees and managers should know how to effectively speak up about offensive behavior. Educating your workforce can help them recognize and prevent it. The Manager's Edition is an extended version of the employee-only program (Essentials).
