| Employer
liability for sexual harassment has increased dramatically in recent
years. In 1998, for example, the U.S. Supreme Court ruled that not
only is same-gender sexual harassment illegal, but also that an employer
can be found liable, even if the victim does not suffer any adverse
job consequences as a result of the harassment. The Supreme Court
rulings did, however, outline potential mitigating considerations,
including whether the employer exercised reasonable care in advance
to prevent and correct any harassing behavior; and whether the victim
unreasonably failed to take advantage of any corrective or preventive
mechanisms established by the employer. |
